DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW

          On February 14, 1989, the above named petitioner filed a Petition 
          for Administrative Review against a  "termination  letter"  dated
          January 24, 1989, by a staff attorney of the Enforcement  Section
          concerning the housing accommodations  located  at  32  Cathedral
          Avenue, Apartment 2E, Manhasset, New York.  Said letter  asserted
          that  no  further  Enforcement  action  was  warranted  and   the
          proceeding terminated as the matter  had  been  determined  by  a
          prior Court proceeding.  Said termination was  without  prejudice
          to a subsequent refiling based upon new or additional facts.

          The Emergency Tenant Protection Act provides  that  an  aggrieved
          party may file a Petition for Administrative  Review  against  an
          order issued by the Rent  Administrator.   A  termination  letter
          issued  by  the  Enforcement  Section  does  not  constitute   an
          appealable order issued by a Rent Administrator.   This  petition
          must therefore be terminated.

          THEREFORE, in accordance with the Rent and  Eviction  Regulations
          for New York City, the  Rent  Stabilization  Law,  the  Emergency
          Tenant Protection Act of 1974, and Chapter 403, Laws of 1983,  as
          amended by Chapter 102 of the Laws of  1984,  as  implemented  by
          Operational Bulletin 84-1, it is

          ORDERED, that this Petition for Administrative Review be and  the
          same is hereby terminated.
