ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On July 26, 1988, the above-named owner filed a Petition for
Administrative Review against an order issued on June 29, 1988, by
a Rent Administrator, concerning the housing accommodations known
as apartment 1 at 115 Parkside Avenue, Brooklyn, wherein the
Administrator determined that the owner had overcharged the tenant.
That order states inter alia: that the 1984 registered rent
constituted the Initial Legal Registered Rent for those
accommodations; that the rent charged under a one-year lease
commencing on December 1, 1985 had been $572.77; and that a rent
overcharge of $5197.47 had occurred.
The instant petition consists entirely of a reference, without
comment, to attached exhibits: copies of the 1984 and 1985
registration statements for the subject accommodations, and of the
first page of a lease therefor, commencing in November of 1985 and
terminating a year later, the monthly rental being $572.77.
The Commissioner is of the opinion that the petition should be
denied.
It is obvious that the petition cites no error on the
Administrator's part. Nor do the exhibits imply such error, as the
relevant information in the 1984 registration and the
aforementioned lease is already incorporated in the Administrator's
order. In addition the 1985 registration information cannot be
considered as it was not submitted in the proceeding before the
Rent Administrator and the April 1, 1985 rent listed in such
registration is not backed up by the submission of a lease for that
period. Thus the owner has provided no reason to disturb the order
in question.

THEREFORE, in accordance with the Rent Stabilization Law and Code,
it is
ORDERED that this petition be, and the same hereby is, denied, the
Rent Administrator's order being hereby affirmed.
