                      ORDER AND OPINION TERMINATING PROCEEIDNG


              On June 15, 1988, the above-named petitioner-Thames Realty Co. 
          filed a Petition for Administrative Review against an order issued 
          on May 26, 1988, by the Rent Administrator of the Gertz Plaza, 
          Jamaica, New York, concerning housing accommodations known as 
          Apartment 4th floor South at 21-23 Thames St, New York, New York. 
          wherein the Rent Administrator determined that the owner had failed 
          to substantiate good faith in his application to qualify for a 
          certificate of eviction to house a resident janitor.

              By letter dated September 20, 1988, tenant's counsel presented 
          an agreement with owner's counsel, withdrawing owner's petition for 
          Administrative Review.

              The Commissioner is accordingly of the opinion that this 
          proceeding should be terminated.

              THEREFORE, in accordance with the Rent Control Law and the Rent 
          and Eviction Regulations, it is

              ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
