            ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW
                       AND REVOKING RENT ADMINISTRATOR'S ORDER

               On June 29, 1988 the above named petitioner-owner filed a 
          Petition for Administrative Review against an order of the Rent 
          Administrator issued May 25, 1988. The order concerned housing 
          accommodations known as Apt. 4D located at 160 Ocean Parkway, 
          Brooklyn, N.Y.  The Administrator directed restoration of services 
          and ordered a rent reduction for failure to maintain required 
          services.  

               The Commissioner has reviewed the record and carefully 
          considered that portion relevant to the issues raised by this 
          appeal.

               The tenant commenced this proceeding on November 18, 1987 by 
          filing a Statement of Complaint of Decrease in Services and 
          alleged, in sum, that there were defective windows throughout the 
          apartment.

               The owner was served with a copy of the complaint and afforded 
          an opportunity to respond. The owner filed a response stating that 
          the necessary repairs would be made.  In a later submission 
          received by the Division on May 3, 1988 the owner provided the 
          Administrator with a statement from the tenant to the effect that 
          the windows had been repaired to the tenant's satisfaction and that 
          the complaint was being withdrawn.
           
               The Administrator ordered a physical inspection of the subject 
          apartment.  The inspection was conducted on April 18, 1988 and 
          confirmed the tenant's allegations with regard to defective 
          windows.  The Administrator issued the order here under review on 
          May 25, 1988 and ordered a rent reduction based on the inspector's 
          report.

               On appeal the owner, as represented by counsel, states that 
          the tenant withdrew the instant complaint prior to the issuance of 
          the Administrator's order and that, therefore, the proceeding 
          should have been terminated.  The owner argues for revocation of 
          the order here under review on this basis.  The petition was served 
          on the tenant on August 22, 1988. 
           
               After careful review of the evidence in the record, the 
          Commissioner is of the opinion that the petition should be granted 
          and that the order here under review should be revoked.

               The Commissioner agrees with the owner that the proceeding 
          should have terminated upon receipt of the above described 
          statement from the tenant to the effect that the windows had been 
          satisfactorily repaired and that the proceeding was being 
          withdrawn. Therefore, the order here under review is revoked.
          The Division's records reveal that the tenant has vacated the 
          apartment.

               THEREFORE, pursuant to the Rent Stabilization Law and Code it 
          is 

               ORDERED, that this petition be, and the same hereby is, 
          granted, and that the Rent Administrator's order be, and the same 
          hereby is, revoked.
