           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


     The above-named tenant filed a timely petition for administrative review 
     of an order issued concerning the housing accommodations described above.

     The Commissioner has reviewed all the evidence in the record and has 
     carefully considered that portion of the record relevant to the issues 
     raised by the petition.

     The owner commenced these proceeding by filing an Application for Increase 
     of Maximum Rent before the Administrator.  In said Application the owner 
     requested a monthly rent increase of $16.24 from the tenant, said rent 
     increase based upon the purchase and installation of a new refrigerator in 
     the subject premises.  The tenant, by her signature to the application, 
     indicated her assent to the rent increase.

     The Administrator issued an Order directing the owner to increase the rent 
     on the subject premises by $16.24 per month.

     In her petition, the tenant contends that she paid $274.30 to the owner as 
     a "retroactive increase" and that this retroactive increase was apparently 
     over and above the $16.24 ordered by the Administrator, which the tenant 
     also paid.

     The Commissioner is of the opinion that this petition should be denied.

     The tenant made her allegations for the first time on appeal, even though 
     they were available to her below.  As such they cannot be considered by 
     the Administrator.  Moreover, the tenant has not documented her claims 
     made on appeal.

     The tenant did not allege error in law or fact in the Administrator's 
     order.  The tenant is hereby notified by the Commissioner that this Order 
     is issued without prejudice to the tenant's filing a complaint of rent 
     overcharge.

     THEREFORE, in accordance with the provisions of the Rent and Eviction 
     Regulations, it is 

     ORDERED, that this petition for administrative review be, and the same 







          DOCKET NO.:  CE 420030-RT

     hereby is, denied, and, that the order of the Rent Administrator be, and 
     the same hereby is, affirmed.
