                      ORDER AND OPINION TERMINATING PROCEEDING



              On March 24, 1988, the above-named tenant filed a petition for 
          administrative review of an order issued on February 19, 1988 by a 
          Administrator concerning the housing accommodation known as 31 B 
          Elk Court, Hempstead, New York.

              Subsequent to the filing of the tenant's petition, the rent 
          agency mailed two written inquiries, dated October 29, 1993 and 
          December 14, 1993, to the subject tenant which requested whether 
          there is still an active issue to be determined with respect to the 
          aforementioned petition.  Both inquiries were returned to the rent 
          agency by the post office in envelopes respectively marked 
          "Undeliverable As Addressed-Forwarding Order Expired."

              The record reflects that the subject tenant had hand delivered 
          her petition for administrative review to the rent agency in an 
          envelope listing a new address for the  subject tenant.

              The rent agency mailed two written inquiries, dated November 
          19, 1993 and December 14, 1993, to the address listed on the above- 
          mentioned envelope.  The inquiries also requested whether there is 
          still an active issue to be determined with respect to the 
          aforementioned petition.  The Commissioner finds that the subject 
          tenant did not respond to the above-mentioned inquiries.

              Based upon the above-mentioned facts the Commissioner finds 
          that this proceeding should be terminated as moot.

              THEREFORE, in accordance with the provisions of the Rent and

          Evictions Regulations of New York City, it is

              ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
