         ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW


      On February 8, 1988, the above-named petitioner-owner filed a Petition 
      for Administrative Review against an order issued on January 6, 1988 by 
      the Rent Administrator 10 Columbus Circle, New York, New York concerning 
      the housing accommodations known as 345 East 81st Street, Apartment 11D, 
      New York, New York. 

      On March 25, 1988, the owner and the tenant signed an agreement that 
      upon the sale of the subject premises to the tenant, the owner would 
      withdraw its appeal.

      On May 4, 1988 the tenant advised the DHCR that it had purchased the 
      subject premises and that the owner's petition should be withdrawn.

      Although the owner was afforded an opportunity to respond, it failed to 
      do so.

      Accordingly, the Commissioner finds that this appeal should be 
      terminated.

      THEREFORE, in accordance with the provisions of the Rent Stabilization 
      Law and Code, it is

      ORDERED, that this petition be, and the same hereby is, terminated and 
      the order of the Rent Administrator be, and the same hereby is affirmed.
