ORDER AND OPINION TERMINATING PROCEEDING AS MOOT
On February 2, 1988, the above-named petitioner-tenant re-filed a
petition for administrative review (PAR) of an order issued on
December 1, 1987, by the Rent Administrator, concerning the housing
accommodation known as 7502 Ridge Boulevard, Brooklyn, NY,
Apartment D9, wherein the Administrator granted the owner's
application for a rent increase which was based on the installation
of a major capital improvement (MCI).
The Commissioner has reviewed all of the evidence in the record and
has carefully considered that portion of the record relevant to the
issue raised by the administrative appeal.
The owner commenced the instant proceeding by initially filing an
application for a rent increase predicated on the installation of
a burner/boiler at a total cost of $26,000.00.
In Docket No. AH230013OM, issued on December 1, 1987, the Rent
Administrator approved the owner's MCI application by authorizing
a rent increase of $2.48 per room, per month, for all rent
controlled and rent stabilized apartments in the subject building.
The Commissioner notes that the tenant withdrew his petition by
filing a letter on May 17, 1988, which stated that he and the owner
had reached an amicable settlement and requesting that the petition
be withdrawn.
In view of the foregoing, the Commissioner is of the opinion that
the tenant's administrative appeal against the original decision of
the Administrator under Docket No. CB210245RT should be terminated
as moot.
THEREFORE, in accordance with the applicable provisions of the Rent
Stabilization Law and Code, it is
ADMIN REVIEW DOCKET NO. CB210245RT
ORDERED, that this petition be and the same hereby is, terminated
as moot.
