DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

          On January 6, 1988, the above-named petitioner-tenant timely 
          refiled a petition for administrative review of an order issued on 
          October 1, 1987, by the Rent Administrator, concerning the housing 
          accommodation known as 543 West 144th Street, Apt. 8, New York,   
          New York, wherein the Administrator granted the owner's rent 
          restoration application based on the tenant's failure to keep 
          scheduled inspection appointments.
            
          The Commissioner has reviewed all of the evidence in the record and 
          has carefully considered that portion of the record relevant to the 
          issue raised by the administrative appeal.

          This proceeding was commenced by the filing of an application to 
          restore rent dated October 25, 1986.  Thereafter, on May 5, 1987 
          and June 11, 1987, on notice to the tenant, inspections were 
          scheduled.  On both occasions, the tenant failed to keep the 
          appointment, resulting in the Administrator's order of October 1, 
          1987 restoring the rent.

          In the PAR, the tenant contends that she has not had a rent 
          decrease, only increases; that the current owner purchased the 
          building on or about 1984; that she was not advised of a rent 
          increase; and that on other occasions other tenants have let 
          inspectors into her apartment.

          After careful consideration, the Commissioner is of the opinion 
          that the petition should be denied.


          It was proper for the Administrator to restore the rent based on 
          the report of its inspector which asserted that the tenant had

          failed to keep two inspection appointments.  The tenant's petition 
          does not make clear her objections to the order and, therefore, 
          does not establish any basis for modifying or revoking the 
          Administrator's order.

          THEREFORE, in accordance with the City Rent Stabilization Law and 
          the Rent and Eviction Regulations, it is

          ORDERED, that this petition be, and the same hereby is, denied, and 
          that the Rent Administrator's order be, and the same hereby is, 
          affirmed.
