DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                     ORDER AND OPINION TERMINATING PROCEEDING


      The above-named petitioner filed a petition for Administrative review of 
      an order issued by the Rent Administrator resolving the tenant's 
      overcharge complaint based upon the tenant's objection to the services 
      registered by the owner on the initial apartment registration statement.

      Pursuant to Section 2523.4 of the Rent Stabilization Code, an owner is 
      required to maintain all required services as defined by Section 
      2520.6(r) regardless of whether the services are registered.  If there 
      is a failure to maintain required services, the tenant may apply to the 
      Division for a rent reduction, and any dispute as to whether a service 
      is required or has been reduced will be determined in that proceeding.

      Accordingly, the Commissioner is of the opinion that it is unnecessary 
      to decide the issues raised in this appeal.

      Since this decision does not determine the merits of the issues raised 
      on appeal, the order below shall not be used in any subsequent 
      proceeding involving base date or required services.

      THEREFORE, in accordance with the Rent Stabilization Law and Code, it 
      is,

      ORDERED, that this proceeding be, and the same hereby is, terminated.
