           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On November  22,  1988  the  above-named  petitioner-owner  filed  a
        Petition for  Administrative  Review  against  an  order  issued  on
        October 18, 1988 by the Rent Administrator at Gertz Plaza,  Jamaica,
        New York, concerning the housing accommodation known as 35-07  147th
        Street, Queens, New  York,  wherein  the  Administrator  denied  the
        owner's application to restore rent reduced  by  an  Administrator's
        order (AJ-130016-B), upon a finding  of  a  diminution  of  services
        building-wide.

        The applicable law  is  Section  2202.16  of  the  Rent  &  Eviction
        Regulations and Section 2520.6(r) of the Rent Stabilization Code.

        The owner commenced this proceeding  by  filing  an  application  to
        restore rent asserting that the condition which had given use to the 
        rent reduction, i.e. defective  vestibule  door  bell  cover  plate,
        roach infestation in incinerator and basement  rooms  and  defective
        building entrance door lock, had been corrected.

        Based on an inspection of the premises on September  6,  1988  which
        disclosed  that  the  condition   had   not   been   corrected   the
        Administrator denied the owner's application.

        In the petition, the owner argues, as below, that the vestibule door 
        lock  bell  plate  had  been  repaired  in   connection   with   the
        installation of a new intercom system in September  1987,  that  the
        building entrance walkway  had  been  repaired  in  connection  with
        sidewalk repairs completed in  November  1988  and  that  the  owner
        provided periodic exterminating service.  By way  of  documentation,
        the owner submitted various paid invoices.

        The Commissioner notes that the Administrator  properly  denied  the
        owner's application to restore rents based on an inspector's report, 
        prepared by a rent agency employee, not a party to the  proceedings,
        and not an adversary to the tenant.  The rent was properly placed on 
        the record for the consideration by the Administrator and was 

        entitled to substantial weight.


        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,
        and the Emergency Tenant Protection Act of 1974, it is

        that the District Rent Administrator's order be, and the same hereby 
        is, affirmed.
