            ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW


               On October 19, 1988 the above named petitioner-owner filed  a
          Petition for Administrative Review  against  an  order  issued  on
          September 19, 1988 by the Rent Administrator, 50  Clinton  Street,
          Hempstead,  NY  concerning  housing  accommodations  known  as   2
          Terrace Circle, Great Neck, New York, Apartment No. 3H.

               The Commissioner has reviewed all  of  the  evidence  in  the
          record and has carefully considered that  portion  of  the  record
          relevant to the issue raised by the administrative appeal.  

               On September 19, 1988,  the  Rent  Administrator  issued  the
          order appealed herein directing the owner  to  renew  the  subject
          tenant's  lease  and  barring  the  owner  from   collecting   the
          appropriate guideline increase for 90 days after  the  first  rent
          payment date following the receipt of the  renewal  lease  by  the
          subject tenant. 

               In this petition, the owner contends, in substance,  that  it
          is not required to offer a lease to the subject tenant,  that  the
          subject tenant is not the tenant of record and  is  therefore  not
          entitled to a renewal lease.  The owner indicates that a  holdover
          proceeding  had   been   commenced   against   said   tenant   and
          subsequently submits a copy of a transcript of  a  stipulation  of
          settlement reached in District Court on October 27, 1988 in  which
          the subject tenant consented, among other things, to  entry  of  a
          final judgment of possession in favor of the owner.    

               The tenant was served with a copy of  the  petition  and  the
          stipulation of settlement and provided an  opportunity  to  reply.
          The tenant did not submit a response.





           

               After a careful  consideration  of  the  entire  evidence  of
          record  and  in  view  of  the  above  mentioned  stipulation   of

          settlement entered into by the owner and the subject  tenant,  the
          Commissioner is of  the  opinion  that  this  petition  should  be
          granted. 

               THEREFORE,  in   accordance   with   the   Emergency   Tenant
          Protection Act of 1974 and the Tenant Protection  Regulations,  it
          is

               ORDERED, that this petition  be,  and  the  same  hereby  is,
          granted, and the Rent  Administrator's  order  be,  and  the  same
          hereby is, revoked in its entirety.
