ORDER AND OPINION TERMINATING PROCEEDING
On May 28, 1988, the above-named petitioner-owner timely re-
filed a petition for administrative review against an order issued
on April 11, 1988, by the District Rent Administrator, Gertz Plaza,
Jamaica, New York, concerning housing accommodations known as
apartment 4-W located at 167 East 106th Street, New York, New York,
wherein the Administrator denied the owner's application for a
Certificate of Eviction as to the subject rent controlled
apartment.
The Commissioner finds that subsequent to the re-filing of
this Petition, the Administrator re-opened the proceeding below and
reconsidered the order appealed herein in a proceeding commenced on
notice to the parties herein and assigned Docket Number CI 420016
RP.
Therefore, the Commissioner finds that the proceeding brought
on by the filing of the instant Petition and assigned Docket Number
CE 410317 RO should be terminated as premature.
THEREFORE, pursuant to all of the applicable statutes and
regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
