ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On April 4, 1988, the above-named landlord timely filed a
petition for administrative review of an order issued on February
26, 1988 by a Rent Administrator concerning various housing
accommodations in the premises known as 99 Madison Street, New
York, New York.
The Commissioner has reviewed all of the evidence in the record
and has carefully considered that portion of the record relevant
to the issues raised by the petition for review.
On June 19, 1986, the rent agency issued an "Interim Order of
Eligibility," for the subject building's 1986-1987 maximum base
rent (MBR).
In the order under review herein, the Administrator revoked its
earlier order issued on June 19, 1986, and issued a new "Interim
Order of Eligibility," for the subject building's 1986-1987 MBR,
based upon actual figures which were submitted by the subject
landlord.
The subject landlord's petition merely asserts that the rent
agency was in error in revoking the Administrator's order issued on
June 19, 1986.
To the petition the landlord attaches a form entitled
"Challenge Re: Maximum Base Rent Order."
After careful consideration, the Commissioner is of the opinion

that the subject landlord's petition should be denied.
The Commissioner notes that the aforementioned challenge, which
is attached to the landlord's petition, does not state any
objections to the rent agency's MBR order.
Furthermore, the Commissioner finds that the subject landlord's
petition does not raise any issues which would warrant a revocation
of the Administrator's order.
Accordingly, the Commissioner finds that the subject landlord's
petition should be denied.
THEREFORE, in accordance with the City Rent and Rehabilitation
Law and the Rent and Eviction Regulations, it is
ORDERED, that this petition be, and the same hereby is, denied,
and that the District Rent Administrator's order be, and the same
hereby is, affirmed.
