ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
On March 18, 1988, the above-named tenant filed a petition for
administrative review of an order issued on February 19, 1988 by a
District Rent Administrator concerning the housing accommodations known
as 420 East 79th Street, Apartment 8B, New York, New York wherein the
Administrator determined that the owner had overcharged the tenant.
This proceeding was commenced upon the filing of an overcharge
complaint. The Administrator found that an overcharge had occurred.
Both the owner and the tenant filed petitions for administrative review
of that order. Due to an inadvertant clerical error the two petitions
were not merged or consolidated. The Commissioner issued an order and
opinion in the owner's petition under Docket No. CC 410335 RO, while the
tenant's petition remained open.
Under Docket No. CC 410335 RO, the Commissioner ordered that the case be
remanded for further processing. Because all of the issues raised by
the tenant in this petition have been considered by the Administrator in
the remanded case under Docket No. CL 410031 RP, this petition for
administrative review is terminated as moot.
THEREFORE, in accordance with the Rent Stabilization Law and Code, it is
ORDERED, that this petition be, and the same hereby is, terminated.
