DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW


               On February 9, 1988, the above named petitioner-tenant filed 
          a petition for administrative review against an order  issued  on
          January 25, 1988  by  the  Commissioner  concerning  the  housing
          accommodation known as 212-04/12 73rd Avenue, Bayside, New  York,
          Various  Apartments,  wherein  the  Commissioner  adjudicated   a
          tenant's petition against an order  granting  the  owner  a  rent
          increase for a major capital improvement.

               The petitioner is advised that a petition for administrative 
          review may not be filed against a Commissioner's order which is a 
          final agency determination that can only be reviewed in  a  court
          of competent jurisdiction in a  proceeding  brought  pursuant  to
          Article 78 of the Civil Practice Law and Rules.
               
               THEREFORE, in accordance with the Rent Stabilization Law and 
          Code, it is

               ORDERED, that this  petition  be  and  the  same  hereby  is
          terminated.
