            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
                                          

          On June 2, 1988, the above-named petitioner-tenant refiled a peti- 
          tion for administrative review (PAR) of an order issued on March 
          10, 1988, by the Rent Administrator, concerning the housing 
          accommodation known as 4505 Surf Avenue, Apartments 8 & 9, 
          Brooklyn, New York, wherein the Administrator denied the tenant's 
          complaint on the basis that the tenant failed to provide access to 
          the apartment for inspection.

          The Commissioner has reviewed all of the evidence in the record and 
          has carefully considered that portion of the record relevant to the 
          issue raised by the administrative appeal.

          The proceeding was commenced by the filing of a complaint of de- 
          crease in apartment services dated October 26, 1987.  By notices 
          dated December 9, 1987 and December 17, 1987, the tenant was 
          advised of the Division's intentions to inspect the apartment on 
          December 16, 1987 and December 28, 1987.  The tenant failed to keep 
          either appointment resulting in the order herein appealed.

          In the PAR, the tenant contends that he was never informed of the 
          inspection dates and claims that the landlord has tampered with his 
          mail.

          The Commissioner is of the opinion that the tenant's PAR should be 
          denied.

          The method of notice used by the Administrator was entirely proper 
          under the circumstances.  Petitioner has presented no evidence to 
          overturn the administrator's order, and there is nothing in the 
          record to support the petitioner's contentions.


          THEREFORE, in accordance with the Rent Stabilization Law and Code, 
          it is

          ORDERED, that this petition be, and the same hereby is, denied, and 
          that the Rent Administrator's order be, and the same hereby, is 
          affirmed.
