ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On May 23, 1988, the above-named petitioner-tenant filed a petition
for administrative review (PAR) of an order issued on April 29,
1988, by the Rent Administrator, concerning the housing accommoda-
tion known as 59 East 79th Street, Apartment 4-A, New York,
New York, wherein the Administrator determined that the tenant had
acknowledged that the condition in her complaint had been resolved.
The Commissioner has reviewed all of the evidence in the record and
has carefully considered that portion of the record relevant to the
issue raised by the administrative appeal.
The proceeding was commenced by the filing of a complaint of de-
crease in services dated October 30, 1987, alleging a non-working
refrigerator. Thereafter on January 13, 1988, the tenant advised
this agency that she was withdrawing her complaint after reaching
an agreement with the owner. An order was issued accordingly.
In the PAR, the tenant contends that the order was issued in error
and that the refrigerator is still non-working or inadequate.
The Commissioner is of the opinion that the tenant's PAR should be
denied.
The tenant's correspondence dated January 13, 1988 bearing Docket
No. BJ420576S clearly indicates that in return for concessions or
promises made by the owner the tenant was withdrawing her com-
plaint. The Administrator's order was, therefore, correct when
issued. The tenant's error provides no basis to overturn the
Administrator's order.

THEREFORE, in accordance with the City Rent Law and the Rent and
Eviction Law and Regulations, it is
ORDERED, that this petition be, and the same hereby is, denied, and
that the Rent Administrator's order be, and the same hereby, is
affirmed.
