ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On April 19, 1988 the above named petitioner-tenant filed a
Petition for Administrative Review against an order of the Rent
Administrator issued April 7, 1988. The order concerned housing
accommodations known as Apt. 421 located at 144-54 Sanford Ave.,
Flushing, N.Y. The Administrator granted the owner's rent
restoration application.
The Commissioner has reviewed the record and carefully
considered that portion relevant to the issues raised by this
appeal.
The owner commenced this proceeding on July 23, 1987 by filing
a rent restoration application wherein it alleged that it
had restored services for which a rent reduction order bearing
Docket No. AI110439S was issued. The Commissioner notes that the
rent had been ordered reduced based on findings of defective and
leaking kitchen faucet and roach infestation in the kitchen and
bathroom. The tenant was served with a copy of the complaint and
afforded an opportunity to respond.
The Administrator ordered a physical inspection of the subject
apartment. The inspection was conducted on February 12, 1988 and
revealed that the owner had restored services.
The Administrator issued the order here under review on April
7, 1988 and ordered rent restoration based on the inspector's
report.
On appeal the tenant states that no rent reduction was given
in the order here under review. The petition was served on the
owner on June 6, 1988.

After careful review of the evidence in the record, the
Commissioner is of the opinion that the petition should be denied.
The tenant has not stated a valid objection to the order here
under review. The rent reduction the tenant speaks of was granted
in the rent reduction order and the Administrator correctly issued
the rent restoration order based on the above described inspector's
report. The order here under review is affirmed.
THEREFORE, pursuant to the Rent Stabilization Law and Code it
is
ORDERED, that this petition be, and the same hereby is,
denied, and that the Rent Administrator's order be, and the same
hereby is, affirmed.
