                           ORDER AND OPINION TERMINATING PROCEEDING

                    On December 16, 1987, the above-named petitioner-tenant timely 
               filed a Petition for Administrative Review (PAR) against an order 
               issued on December 8, 1987, by the District Rent Administrator, 
               Gertz Plaza, Jamaica, New York, concerning housing accommodations 
               known as apartment 31 located at 640 Ditmas Avenue, Brooklyn, New 
               York, wherein the Administrator, had determined the maximum 
               collectible rent for the subject rent controlled housing 
               accommodation from and including January 1, 1984 through and 
               including January 1, 1987 and the applicable fuel cost adjustments 
               effective January 1, 1980 through, and including, January 1, 1985. 
                    In the PAR, the tenant asserted that the fuel cost adjustments 
               set forth in the appealed order were incorrect. 
                    The Commissioner finds that subsequent to the filing of this 
               Petition, the Division's inquiry as to the status of the underlying 
               dispute was returned marked "Moved-Not Forwardable"; that the 
               subject apartment has been registered with the Division as vacancy 
               decontrolled and rented to a new tenant, under the Rent 
               Stabilization Law, on July 1, 1990; and that the owner of the 
               subject buildng responded to the Division's inquiry as to the 
               whereabouts of the tenant by advising the Division that the tenant 
               died about four years ago.
                    Therefore, the Commissioner finds that the proceeding brought 
               on by the filing of the instant Petition and assigned Docket Number 
               BL220021RT should be terminated.
                    THEREFORE, pursuant to all of the applicable statutes and 
               regulations, it is
                    ORDERED, that this proceeding be, and the same hereby is, 
               terminated.
