ORDER AND OPINION TERMINATING PROCEEDING
The above-named petitioner-landlord timely filed a Petition
for Administrative Review against an order issued on October 19,
1987, by the Rent Administrator, 50 Clinton Street, Hempstead, New
York, concerning housing accommodations known as apartment B-5
located at 12 Hempstead Avenue, Rockville Centre, New York, wherein
the Administrator terminated the proceeding commenced by the
landlord for leave not to renew the tenant's lease and directed the
landlord to offer the tenant a renewal lease.
The Commissioner finds that subsequent to the filing of this
Petition, the landlord has withdrawn the Petition in writing,
advising the Division that the landlord and the tenant have settled
the matter.
Therefore, the Commissioner finds that the proceeding brought
on by the filing of the instant Petition and assigned Docket Number
BK710098RO should be deemed withdrawn and said proceeding should be
terminated.
THEREFORE, pursuant to all of the applicable statutes and
regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
