ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
The above-named tenant filed a timely petition for
administrative review of an order issued concerning the housing
accommodations described above.
The Commissioner has reviewed all the evidence in the record
and has carefully considered that portion of the record relevant to
the issues raised by the petition.
The owner commenced this proceeding by filing an application
for a rent increase in the subject premises said increase based on
owner's contention that adults not immediately related to the
tenant had moved into the subject premises.
In her answer, the tenant stated that she lived in the
apartment with her sister, her sister's husband, and her sister's
daughter.
The rent administrator issued an order increasing the tenant's
rent.
In her petition the tenant reiterates the arguments she made
below.
The Commissioner is of the opinion that this petition should be
denied.
An examination of the record below reveals finds that the rent
for the subject premises was $166.97 per month at the time the
owner submitted the application for rent increase. Further
examination reveals that the Administrator found that, contrary to
the owner's initial claim of 4 unrelated adults living with the

tenant, there was only one. The Administrator increased the rent
by $16.70 (10% of $166.97) per month, such 10% rent increase being
consistent with guidelines set forth in the Rent and Eviction
Regulations. A brother-in-law is not included in the definition
of "immediate family member" in the Rent and Eviction Regulations.
THEREFORE, in accordance with the provisions of the Rent and
Eviction Regulations, it is
ORDERED, that this petition for administrative review be, and
the same hereby is, denied, and, that the order of the Rent
Administrator be and the same hereby is, affirmed.
