            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW



          On September 1, 1987, the above-named petitioner-owner filed a 
          petition for administrative review of an order issued on August 10, 
          1987, by the Rent Administrator at Gertz Plaza, Jamaica, New York 
          concerning the housing accommodations known as Apt. #2B at 2014 
          Second Avenue, New York, New York, wherein the Administrator found 
          that the owner had failed to timely file a report of a decrease in 
          the cost of the heating fuel the owner had used. Consequently, the 
          Administrator's order provided that the owner had not been entitled 
          to collect the total accumulated fuel cost adjustments during the 
          calendar year 1985 and directed the owner to refund, to the tenant, 
          any fuel cost adjustments collected during 1985. The order also 
          provided for the restoration of the fuel cost adjustments (at the 
          recalculated, reduced, amount) as of January 1, 1986.



          The Commissioner has reviewed all the evidence in the record and 
          has carefully considered that portion of the record relevant to the 
          issues raised by the Petition.



          In the Petition the owner asserts that it has refunded the 1985 
          fuel cost adjustments it had collected; that it has not charged the 
          tenant any additional monies for 1986; that the owner has not 
          collected any fuel cost adjustments from the tenant for 1986 or

          1987. The owner asks that the Administrator's order be modified, 
          but does not specify the nature of the modification sought.

                                 
          The Commissioner is of the opinion that the Petition should be 
          denied.


          The Commissioner finds that the petitioner has set forth no grounds 
          upon which the revocation or modification of the appealed order 
          could be based. The Commissioner notes that if, at the time the 
          appealed order was issued, the petitioner-owner had refunded and/or 
          not collected funds determined, in the appealed order, to be in 
          excess of the maximum the petitioner-owner was entitled to collect, 
          the petitioner-owner owed nothing further under the appealed order.


          THEREFORE, in accordance with all of the applicable laws and 
          regulations, it is

          ORDERED, that this Petition be, and the same hereby is, denied, and 
          that the order of the Administrator be, and the same hereby is, 
          affirmed.
