ORDER AND OPINION TERMINATING PROCEEDING
On September 1, 1987, the above-named tenant filed a petition
for administrative review of the subject apartment's "Rent Control
Registration Update Card" (hereinafter known as Registration Card),
concerning the housing accommodation known as Apartment 5A, 1775
East 18th Street, Brooklyn, New York.
The Commissioner notes that the above-mentioned Registration
Card is not an order of the rent agency, but is a record of the
rent agency which is used to update changes in the apartment's
maximum rent and maximum base rent.
The Commissioner further notes that the aforementioned
Registration Card did not make a determination on the merits, but
was a restatement of the rights and obligations already existing
between the subject tenant and landlord.
As there has been no order issued by the Administrator in this
proceeding for the Commissioner to review, the Commissioner is of
the opinion that this proceeding should be terminated.
The Commissioner notes that this order is issued without

prejudice to the tenant's right to request an administrative
determination, upon written request to the Administrator of the
rent agency's Owner Individual Unit, to determine the tenant's
maximum rent, pursuant to Section 2202.22 of the City Rent and
Eviction Regulations.
THEREFORE, in accordance with the provisions of the City Rent
and Rehabilitation Regulations, and the Rent and Eviction
Regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
