                     ORDER AND OPINION TERMINATING PROCEEDING


      On August 24, 1987 the above named petitioner filed a Petition for 
      Administrative Review (PAR) against an order issued on August 7, 1987, 
      by the Rent Administrator, of the District Rent Office.

      A check of agency apartment registration records indicates that the 
      petitioner-tenant has vacated the subject apartment.  A new tenant has 
      been residing in the apartment since November 1, 1991.

      The subject petition concerns the former tenant's contention that she 
      should be exempt from the Major Capital Improvement (MCI) increase 
      granted in the subject order, due to her eligibility for Senior Citizen 
      Rent Increase Exemption (SCRIE).

      Since SCRIE exemptions are not transferable, and the petitioner-tenant 
      has vacated; the subject PAR is moot.  And should be terminated.

      THEREFORE, in accordance with the provision of Chapter 403, Laws of 
      1983, as amended by Chapter 102, Laws of 1984, as implemented by 
      Operational Bulletin 84-1, it is 

      ORDERED, that this Administrative Review proceeding be, and the same 
      hereby is, terminated.
