                      ORDER AND OPINION TERMINATING PROCEEDING

          The above-named petitioner-landlord timely filed a petition for 
          administrative review against an order issued on June 22, 1987, by 
          a Rent Administrator, 50 Clinton Street, Hempstead, New York, 
          concerning housing accommodations known as apartment 7-T located at 
          380 Front Street, Hempstead, New York, wherein the Administrator 
          determined that the owner had collected an overcharge in the form 
          of a $50.00 late payment fee and $32.00 for "legal fees"; and 
          wherein the Administrator directed the owner to refund said sums, 
          totalling $82.00, to the tenant.

          The Commissioner finds that the tenant has vacated the subject 
          apartment, that the overcharge found does not effect the 
          calculation of the legal regulated rent for the subject apartment 
          and the petitioner-landlord has failed to respond to the Division's 
          inquiries as to the status of the underlying dispute.

          Therefore, the Commissioner finds that the proceeding brought on by 
          the filing of the instant Petition and assigned Docket Number 
          BG710404RO should be deemed withdrawn and said proceeding should be 
          terminated.

          THEREFORE, pursuant to all of the applicable statutes and 
          regulations, it is

          ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
