          ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW

      On July 24, 1987, the above-named petitioner-owner filed a Petition for 
      Administrative Review against an order issued on June 19, 1987, by the 
      Rent Administrator, 92-31 Union Hall Street, Jamaica, New York, 
      concerning the housing accommodations known as 2 East 75th Street,      
      New York, New York, Apartment No. 2C, wherein the Administrator directed 
      the owner to offer the tenant a renewal lease.

      The Commissioner has reviewed all of the evidence in the record and has 
      carefully considered that portion of the record relevant to the issue 
      raised by the administrative appeal.  

      The tenant commenced this proceeding on February 4, 1986 by filing a 
      complaint of the owner's failure to renew lease.  The tenant alleged 
      that the owner had refused without valid reason to offer a renewal 
      lease.
           
      In the order herein appealed the Administrator found that the tenant was 
      entitled to a renewal lease and directed the owner to offer one.

      After the administrative appeal was filed, the tenant advised the 
      D.H.C.R. that it was withdrawing its complaint and had voluntarily 
      surrendered possession of the subject apartment to the owner.

      Accordingly, the Commissioner finds that the issues raised by the appeal 
      are mooted and that the petition should be granted.

      THEREFORE, in accordance with the provisions of the Rent Stabilization 
      Law and Code, it is

      ORDERED, that this petition be, and the same hereby is, granted, and the 
      Rent Administrator's order be, and the same hereby is, revoked.
