DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                      ORDER AND OPINION TERMINATING PROCEEDING

               On June 23, 1987, the above-named tenant filed a petition for 
          administrative review of an order issued on June 3, 1987 by the 
          Rent Administrator concerning the housing accommodation known as 
          Apartment 1, 100 North Columbus Avenue, Mt. Vernon, New York.

               On June 3, 1987 the Administrator, under Docket No. 
          AJ810003OE, which is the order under review herein, issued an order 
          granting the landlord a Certificate of Eviction.

               In this petition the subject tenant asserts that the Rent 
          Administrator's granting of the Certificate of Eviction was 
          incorrectly decided.

               The Commissioner notes that in a separate proceeding brought 
          before the rent agency between the subject landlord and tenant, the 
          Administrator issued an order on December 28, 1988, under Docket 
          No. BB810014RV, which stated that:

                    Evidence in the record, i.e., a
                    notice sent to the tenant on 
                    October 20, 1988 by this office
                    returned by the Post Office 
                    stamped 'Attempted-Unknown'
                    indicates that the tenant has 
                    vacated the subject apartment.

               The Commissioner further notes that the above-mentioned 
          Administrator's order issued under Docket No. BB810014RV is a final 
          determination of the rent agency.

               The Commissioner finds that the subject tenant has vacated the 
          subject apartment.  The Commissioner further finds that the issue 
          raised in this proceeding, which is whether the eviction of the 
          subject tenant was warranted, is thereby rendered moot.  
          Accordingly, the Commissioner is of the opinion that this 
          proceeding should be terminated.

               THEREFORE, in accordance with the Emergency Tenant Protection 
          Act of 1974 and the State Tenant Protection Regulations, it is 

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
