                      ORDER AND OPINION TERMINATING PROCEEDING

               On June 20, 1987, the above-named landlord filed a petition 
          for administrative review of an order issued on May 27, 1987 by a 
          Rent Administrator concerning the housing accommodation known as 
          Apartment 6J, 59-29 Queens Boulevard, Woodside, New York.

               The Commissioner points out that subsequent to the filing of 
          the above-mentioned petition, the subject landlord failed to 
          respond to the rent agency's two written inquiries, dated February 
          28, 1994 and March 24, 1994, respectively, as to whether there is 
          still an active issue to be determined with respect to the above- 
          mentioned petition for administrative review.

               Accordingly, the Commissioner is of the opinion that there is 
          no longer an active issue to be determined in this proceeding, and 
          that the Commissioner finds that the subject landlord's petition 
          should be terminated as moot.

               THEREFORE, in accordance with the City Rent and Rehabilitation 
          Law and the Rent and Eviction Regulations, it is 

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
