ORDER AND OPINION TERMINATING PROCEEDING
On May 26, 1987, the above-named landlord filed a petition for
administrative review of an order issued on May 15, 1987 by an
Administrator concerning the housing accommodation known as
Apartment 66, 571 West 139th Street, New York, New York.
Subsequent to the filing of the landlord's petition, the rent
agency mailed two written inquiries, dated March 24, 1994 and April
15, 1994, to the above-mentioned landlord which requested whether
there is still an active issue to be determined with respect to the
aforementioned petition. Both inquiries were returned to the rent
agency by the post office in envelopes marked "Not Deliverable As
Addressed - Unable To Forward." The Commissioner points out that
the rent agency mailed the above-mentioned inquiries to the address
the landlord noted in his petition, which is the same address the
above-mentioned landlord noted in his previous registration
statements submitted to the rent agency.
The rent agency records reflect that there is a new owner of
the subject building.
The rent agency mailed three written inquiries, dated March
24, 1994, April 15, 1994 and April 27, 1994, to the current
registered owner of the subject building which requested whether
there is still an active issue to be determined with respect to the
aforementioned petition. By letter, dated May 18, 1994, the
subject building's current owner noted that there is no longer an
active issue to be resolved in this proceeding, and that the owner
withdraws its petition for administrative review.

Based upon the above-mentioned facts, the Commissioner is
accordingly of the opinion that this proceeding should be
terminated as moot.
THEREFORE, in accordance with the provisions of the Rent and
Eviction Regulations of New York City, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
