DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                     ORDER AND OPINION TERMINATING PROCEEDINGS


          On December 19, 1990 the owner, the  tenant,  their  respective
          attorneys, and an attorney for the  DHCR  entered  into  a  "So
          Ordered" Stipulation of Settlement in a court proceeding in the
          Supreme Court, New York County entitled, Greek Orthodox Church of 
          the Annunciation v. NYS DHCR and Kendall March and Evelyn Leopold, 
          N.Y.Co. Index No. 22606/87, (Pecora, J.).   By  its  terms  the
          stipulation provided that the District Rent Administrator's order 
          issued April 2, 1987 in this proceeding is revoked and the matter 
          remanded to the District Rent Administrator, who upon receipt of 
          a letter signed by the tenant and co-signed by her attorney, would 
          issue an order terminating this proceeding.

          The DHCR is in receipt of a letter signed by the tenant in this
          proceeding and co-signed by the tenant's attorney stating that the 
          tenant withdraws her complaint, bearing docket number L3114506R/T, 
          with prejudice.

          THEREFORE, in accordance  with  Section  2520.13  of  the  Rent
          Stabilization Code, the DHCR accepts the tenant's withdrawal of
          her complaint.  Because the Administrator has not previously done 
          so,  the  Commissioner  hereby  terminates   proceedings   Nos.
          l3114506R/T.  The instant appeal proceeding is also terminated.
