                      ORDER AND OPINION TERMINATING PROCEEDING

               On February 24, 1987, the above-named landlord filed a 
          petition for administrative review of an order issued on January 
          29, 1987 by the Rent Administrator concerning the housing 
          accommodation known as the Third Floor Apartment, 323 Division 
          Avenue, Brooklyn, New York.

               By letter dated January 7, 1994, the landlord withdrew its 
          petition for administrative review.  The Commissioner is 
          accordingly of the opinion that this proceeding should be 
          terminated.

               THEREFORE, in accordance with the City Rent and Eviction 
          Regulations, it is 

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
