DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                      ORDER AND OPINION TERMINATING PROCEEDING

               On January 13, 1987, the above-named landlord filed a petition 
          for administrative review of an order issued on December 17, 1986 
          by a Rent Administrator concerning various housing accommodations 
          in the premises known as 301 East 76th Street, New York, New York, 
          A/K/A 1456 Second Avenue, New York, New York.

               The Commissioner points out that subsequent to the filing of 
          the above-mentioned petition, the subject landlord failed to 
          respond to the rent agency's two written inquiries, dated May 16, 
          1994 and June 13, 1994, respectively, as to whether there is still 
          an active issue to be determined with respect to the above- 
          mentioned petition for administrative review.

               Accordingly, the Commissioner is of the opinion that there is 
          no longer an active issue to be determined in this proceeding, and 
          that the Commissioner finds that the subject landlord's petition 
          should be terminated as moot.

               THEREFORE, in accordance with the City Rent and Rehabilitation 
          Law and the Rent and Eviction Regulations, it is 

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
