ORDER AND OPINION TERMINATING PROCEEDING
On December 18, 1987, the above-named owner filed a petition
for administrative review of an order issued on November 16,
1987, by a District Rent Administrator concerning the housing
accommodation known as Apartment 5G, 1795 Riverside Drive, New
York, New York, wherein rent was reduced due to a diminution of
service.
This proceeding was commenced by the subject tenant by
filing an application for a rent reduction based on the owner's
alleged failure to maintain services.
On November 16, 1987 the District Rent Administrator issued
the order here under review finding that a diminution of services
had occurred and reducing the tenant's rent to the level in
effect prior to the last rent guideline increase which commenced
before the effective date of the rent reduction.
The owner's petition asserts that the subject apartment is
rent controlled, and not rent stabilized, as stated in the
Administrator's order, and therefore, the owner requests that the
Administrator's order should be dismissed.
The Commissioner notes that on March 2, 1988 the District
Rent Administrator issued an amended order, superseding the order
under review, by reducing the maximum legal rent by $12.00 per
month, thereby recognizing that the subject apartment is rent
controlled, and not rent stabilized. Accordingly, as the order
under review has been superseded by the amended order, the
instant proceeding is moot.

THEREFORE, in accordance with the provisions of the Rent
and Eviction Regulations of New York City, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
