          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW


               On November 5, 1987, the above-named petitioner-tenant filed 
          a petition for administrative review of an order issued on October 
          15, 1987, by the Rent Administrator, concerning the housing 
          accommodation known as 204 West 109th Street, Apartment 1B, New 
          York, N.Y., wherein the Administrator determined that based on a 
          physical inspection conducted by DHCR, services are partially 
          restored and, therefore, granted a partial rent restoration.

               In his petition for administrative review, the tenant fails to 
          state any objection to the order.  As there is no justiciable issue 
          to be resolved in this proceeding, the Commissioner is of the 
          opinion that the petition should be terminated.
               
               THEREFORE, in accordance with the provisions of Chapter 403, 
          Laws of 1983, as amended by Chapter 102, Laws of 1984, as 
          implemented by Operational Bulletin 84-1, it is

               ORDERED, that this petition for administrative review be, and 
          the same hereby is, terminated.
