ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
On October 30, 1987 the above-named petitioner-owner filed a
Petition for Administrative Review against a Notice of
Disposition of Tenant's Complaint of Alleged Violation issued on
October 1, 1987 by the Rent Administrator, 92-31 Union Hall
Street, Jamaica, NY concerning housing accommodations known as
140 East 28th Street, Apartment 6-D, New York, New York, wherein
the administrator set forth the collectible rent for the subject
rent controlled housing accommodation for the effective periods
of January 1, 1983, January 1, 1984, January 1, 1986 and January
1, 1987.
In this Petition for Administrative Review the owner
contends in substance that the Administrator omitted the rent
"increase" for the period commencing January 1, 1985.
On February 24, 1988 the DHCR issued a Notice of Disposition
of Tenant's Complaint of Alleged Violation, amending, the Notice
of Disposition appealed herein by including the maximum
collectible rent of $497.52 per month (the Maximum Base Rent
ceiling) for the subject apartment effective January 1, 1985.
There is no further issue to be determined herein.
THEREFORE, in accordance with the Rent and Eviction
Regulations for New York City, it is
ORDERED, that this petition be and the same hereby is
terminated.
