          This Order and Opinion is issued after the Supreme Court, Kings 
          County, Justice  Hittner, "So Ordered" a stipulation dated         
          June 10, 1992, in the Article 78 Proceeding brought by the current 
          owner (Pellet v. D.H.C.R., Supreme Court, Kings County, Index No.  
          9428/92) in which stipulation, the Division and the current owner 
          agreed to the remittitur of these proceedings to the Division for 
          further processing and consideration including the issues raised in 
          said  Article 78 Proceeding.

          The Article 78 Proceeding described above was taken from an Order 
          and Opinion issued on January 28, 1992, which purported to 
          determine (by denying) the administrative appeals filed by the 
          current owner and the prior owner.

          The Commissioner has reviewed all the evidence in the record and 
          has carefully considered that portion of the record relevant to the 
          issues herein.

          The Commissioner notes that the issuance of the Order and Opinion 
          of January 28, 1992 constituted a procedural anomaly. The 
          administrative appeal of the prior owner had been determined by an 
          Order and Opinion issued under Docket Number BK210234RO on July 15, 
          1988, and the administrative appeal of the current owner had been 
          determined by an Order and Opinion issued under Docket Number 
          BK210378RO on August 26, 1988.

          The Commissioner also notes that those two Orders and Opinions 
          remanded the proceedings in question to the Administrator for 
          processing and that the latter of them directed that the 
          proceedings being so remanded be processed on a consolidated basis. 
          The Commissioner further notes that said consolidation never 
          occurred; and that the processing which occurred upon remand 
          consisted, basically, of a notice to the prior owner to submit 
          certain additional evidence, the prior owner's submission of a 
          written withdrawal (posted on November 4, 1988) of its application 
          for an order of decontrol and the Administrator's issuance, on 
          April 18, 1989, under Docket Number CG 210070 RP of an order 
          affirming the Administrator's original order (issued on October 20, 
          1987 under Docket Number BF 210001 UC) denying the owner's 
          application for an order decontrolling the subject apartments.

          The Commissioner points out that the record in Docket Number CG 
          210070 RP does not indicate that the current owner, who appears to 
          have taken title under a deed recorded on December 24, 1987, was 
          served with the order of April 18, 1989, and, therefore, the 
          Commissioner notes, the current owner's time to file an 
          administrative appeal from said order never started to run.

          Based on the foregoing, the Commissioner believes that , as to the 
          current owner and the tenants, these proceedings should be remanded 
          to the Administrator for further processing as outlined in the 
          Order and Opinion of July 15, 1988 (Docket Number BK210234RO; a 
          copy of which is being sent to the parties along with their copy of 
          this Order and Opinion) and that these proceedings should be deemed 
          closed to the prior owner, which withdrew its application and did 
          not appeal the April 18, 1989 order, although served with a copy 

          The Commissioner notes that upon this remand, and in light of the 
          procedural history herein, the current owner may not be deemed to 
          have waived or lost any of his rights herein should he hereafter

          choose not to file an administrative appeal against the order of 
          April 18, 1989 (Docket Number CG 210070 RP).

          THEREFORE, pursuant to all of the applicable statutes and 
          regulations, it is

          ORDERED, that as to the current owner and the tenants, these 
          proceedings are remanded to the Administrator for further 
          processing in accordance with this Order and Opinion; and it is

          ORDERED, that as to the prior owner, these proceedings are 
          terminated; and it is further

          ORDERED, that, until a further order is issued by the Administrator 
          on remand, the relationship between the current owner and the 
          tenants shall be governed by the terms of the Administrator's order 
          of October 20, 1987, issued under Docket Number BF 210001 UC.
