          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW


          On October 23, 1987, the above-named petitioner-tenant  filed  an
          Administrative Appeal against an order issued  on  September  29,
          1987, by  the  District  Rent  Administrator,  92-31  Union  Hall
          Street, Jamaica, New York, concerning the housing  accommodations
          known as 146 Attorney Street, New York, New York, Apartment 3-B.

          The issue to have been determined in this appeal was whether  the
          District Rent Administrator properly issued the appealed order of 
          September 29, 1987, which denied  the  tenant's  complaint  of  a
          decrease in services based upon the tenant's failure to give  the
          Division of Housing and Community Renewal (DHCR) inspector access 
          to her apartment.

          On appeal, the petitioner-tenant alleged that  she  never  denied
          access to the DHCR inspector, but instead had been at home at the 
          scheduled time of each inspection  and  that  the  inspector  had
          failed to keep the designated inspection appointments.

          Given tenant's repeated claims  that  the  DHCR  inspector  never
          appeared for the designated inspection dates  on  July  1,  1987,
          July 13, 1987 and July 20, 1987, a new inspection of the  subject
          apartment was ordered on December 17, 1991.

          The inspector's report of January 3, 1992 stated:

               "Tenant phoned to withdraw,
                Tenant moved to new location."
          In view of the foregoing, the Commissioner is of the opinion that 
          this administrative appeal proceeding should be terminated.

          THEREFORE, in accordance with  the  Rent  Stabilization  Law  and
          Code, it is

          ORDERED, that this appeal proceeding be, and the same hereby  is,
          terminated.
