            ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW
                                       IN PART

               On October 19, 1987 the above-named petitioner-owner filed a 
          petition for administrative review of an order issued on September 
          30, 1987, by the Rent Administrator, concerning the housing 
          accommodation known as 42-49 Colden Street, Apartment 9U, Queens, 
          New York, wherein the Administrator determined the tenant's 
          objection to the 1984 apartment rent/services registration.

               The challenged order, in pertinent part, amended the 
          registration to include numerous service items listed on the 
          tenant's objection form that were omitted in the owner's 
          registration. 

               In a cover letter to the petition, the owner advises that 
          central air conditioning is not provided, points out that the 
          owner's response in the proceedings below acknowledged that air 
          conditioners are provided for the subject apartment, and requests 
          that the records be corrected to reflect that the owner provides 
          two (2) air conditioners.  In fact, the owner's assertions are 
          consistent with the statements in the tenant's objection below that 
          the owner failed to register two air conditioning units.  The 
          services registration shall be amended to reflect these facts, as 
          requested.

               No other error of law or fact were alleged in either the 
          petition or in the cover letter.  


               THEREFORE, in accordance with the Rent Stabilization Law and 












          ADM. REVIEW DOCKET NO.: BJ 110308 RO

          Code, it is

               ORDERED, that this petition be, and the same hereby is, 
          granted and that the Administrator's order is amended to reflect 
          that the owner provides two (2) air conditioning units, not central 
          air conditioning.
