          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW



                    The above-named owner filed a timely petition for 
          administrative review of an order issued on August 10, 1987 
          concerning the housing accommodation known as 1411 Avenue V, 
          apartment L-7, Brooklyn, N.Y., wherein the Administrator ordered a 
          rent reduction based on a finding of a diminution of services.

                    The owner's petition requests reversal of the order, 
          asserting, among other things, that one of the items cited in the 
          order (roach infestation) was not among the conditions cited in the 
          complaint.  

                    The Commissioner is of the opinion that the owner's 
          petition should be terminated.

                    The Division records indicate that the proceeding 
          hereunder review was reopened and reconsidered by the Administrator 
          subsequent to the issuance of the order appealed from, taking note 
          of the owner's claim about lack of notice about the allegation of 
          infestation.  On October 21, 1987, a superseding order was issued 
          by the Administrator under Docket No. ZBH-210003-RP which revoked 
          the August 10, 1987 order in its entirety.  The Division records 
          further indicate that the tenant did not seek administrative review 
          of the October 21, 1987 order, nor has the tenant filed an answer 
          to the instant PAR.

                    In view of the October 21, 1987 order, the Commissioner 
          finds that the instant petition is moot and it should therefore be 
          terminated.

                    THEREFORE, is accordance with the Rent Stabilization Law 
          and Code, it is 

                    ORDERED, that the owner's petition be, and the same 
          hereby is, terminated as moot and the Rent Administrator's August 
          10, 1987 order be, and the same hereby is, revoked in accordance 
          with the Administrator's October 21, 1987 order under Docket No. 
          ZBH-210003-RP.
