          ORDER AND OPINION DISMISSING PETITIONS FOR ADMINISTRATIVE REVIEW


          On September 1,  1987  and  October  16,  1990,  the  above-named
          petitioner  filed  Petitions  for  Administrative  Review  (PARs)
          against orders issued on July 28, 1987 and  September  14,  1990,
          respectively,       by       the       Rent        Administrator.
           
          In a so-ordered stipulation of  settlement  entered  into  before
          Kings County Civil Court, Housing Part 18F (Index L&T 103824/90),
          at which proceeding both parties were represented by counsel, the 
          1553 Realty Company and the tenant, on January 22,  1992,  agreed
          to  withdraw  any  and  all  actions  pending  before  the   DHCR
          concerning the  subject  premises,  and  to  deem  those  actions
          settled by entering into that stipulation.  

          Section  2520.13  of  the  Rent  Stabilization  Code  states,  in
          pertinent part, that based upon a negotiated  settlement  between
          the parties and  with  the  approval  of  a  court  of  competent
          jurisdiction where a tenant is represented by counsel,  a  tenant
          may withdraw, with prejudice, any complaint pending  before   the
          DHCR.

          Accordingly, the Commissioner finds that the withdrawals  are  in
          compliance with the  statute,  and  that  Administrative  Appeals
          Docket Nos. BI 210260 RT and EJ 210263 RT should be dismissed.

          THEREFORE, in accordance with  the  Rent  Stabilization  Law  and
          Code, it is

          ORDERED, that these  petitions  be,  and  the  same  hereby  are,
          dismissed.
