ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On August 10, 1987, the above-named petitioner-owner filed a
petition for administrative review (PAR) of an order issued on July
24, 1987, by the Rent Administrator, concerning the housing
accommodations known as 94-05 222 Street, Queens Village, NY,
various apartments, wherein the Administrator directed the
restoration of services but found a rent reduction unwarranted.
The Commissioner has reviewed all of the evidence in the
record and has carefully considered that portion of the record
relevant to the issue raised by the administrative appeal.
This proceeding was commenced by the filing of various
complaints in March, 1986 alleging a decrease in services. On June
1, 1987 a Division employee conducted an inspection and confirmed
the existence of the complained of conditions which related to
lawn, tree, and fence maintenance. On July 24, 1987 the
Administrator issued an order directing restoration of the services
but found that a rent reduction was not warranted.
In the PAR, the owner denied the conditions confirmed by the
inspector, and contended that they either had been corrected as of
the date of the order, or were the result of tenant abuse.
The Commissioner is of the opinion that this petition should
be denied.
The record presented which includes the results of an on-site
inspection is sufficient to confirm the conditions which gave rise
to the Administrator's order. The owner has presented no evidence
to warrant reversal of the Administrator's determination.

Therefore, in accordance with the provisions of the City Rent
Law, the Rent and Eviction Regulations, and the Rent Stabilization
Law and Code, it is
ORDERED, that this petition be, and the same hereby is, denied
and the Rent Administrator's order be, and the same hereby is,
affirmed.
