            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


               On June 9,  1987,  the  above-named  petitioner  prior  owner
          timely refiled a Petition for  Administrative  Review  against  an
          order issued on February 13, 1987 by  the  Rent  Administrator  10
          Columbus Circle,  New  York,  New  York,  concerning  the  housing
          accommodations known as Apartment 7F at 345 East 56th Street,  New
          York, New York wherein the Rent Administrator determined that  the
          current owner had overcharged the tenant. 

               The Commissioner notes that this proceeding was  filed  prior
          to April 1, 1984.  Sections 2526.1(a) (4)  and  2521.1(d)  of  the
          Rent Stabilization Code (effective May  1,  1987)  governing  rent
          overcharge  and  fair  market  rent   proceedings   provide   that
          determination of these matters be  based  upon  the  law  or  code
          provisions  in  effect  on  March  31,  1984.   Therefore,  unless
          otherwise  indicated,  reference   to   Sections   of   the   Rent
          Stabilization Code (Code) contained herein  are  to  the  Code  in
          effect on April 30, 1987. 

               The issue in this appeal is whether the Rent  Administrator's
          order was warranted.

               The applicable section of the  Law  is  Section  42A  of  the
          former Rent Stabilization Code. 

               The Commissioner has reviewed all  of  the  evidence  in  the
          record and has carefully considered that  portion  of  the  record
          relevant to the issue raised by the administrative appeal.  

               This proceeding was originally commenced  by  the  filing  in
          March 1984 of a rent overcharge complaint by the tenant.




               The current owner was served with a copy of the complaint and 
          was directed to submit a complete rental history for  the  subject

          apartment from the base date including copies of all leases.   The
          current  owner  did  not  submit  a  complete  rental  history  as
          required.  

               In Order Number CDR 29,022, the Rent Administrator determined 
          that due to the current  owner's  failure  to  submit  a  complete
          rental history, the current owner had collected a rent  overcharge
          of $9884.03 through June 30, 1986 and directed the  current  owner
          to refund such overcharge to the tenant.

               In this petition, the prior owner contends in substance  that
          it sold the subject premises on February 11, 1984, that  it  never
          received a copy of the tenant's rent overcharge complaint and that 
          it requests a thirty day extension to  submit  a  complete  rental
          history.

               No further submissions were made by the prior owner.

               The Commissioner is of the opinion that this petition  should
          be denied.

               The Commissioner notes that the tenant's  complaint  was  not
          served on the prior owner and that the Rent Administrator's  order
          did not list, and was not sent to,  the  prior  owner.   Thus  the
          prior owner cannot be said to have been directly affected  by  the
          Rent Administrator's order.  Moreover the prior  owner  has  still
          not submitted a complete rental history for the subject  apartment
          as it advised it would.   Accordingly  the  Commissioner  sees  no
          reason to disturb the Rent Administrator's order.   

               This order is issued without prejudice to the current owner's 
          right, if any, to proceed against the prior  owner  for  any  rent
          overcharge paid to the prior owner by the tenant which the current 
          owner may have refunded to the tenant. 

               THEREFORE, in accordance with the Rent Stabilization Law  and
          Code; it is

               ORDERED, that this petition  be,  and  the  same  hereby  is,
          denied, and the District Rent Administrator's  order  be  and  the
          same hereby is, affirmed.
