ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW,
IN PART AND REMANDING PROCEEDING TO THE ADMINISTRATOR
FOR FURTHER CONSIDERATION
On June 8, 1987, the above named petitioner owner filed a
Petition for Administrative Review (PAR) against an order issued on
May 8, 1987, by the then Rent Administrator located at 10 Columbus
Circle, New York City, concerning the housing accommodations known
as 271 Grand Central Parkway, Apartment 23-A, Floral Park, New
York, wherein the Administrator determined the tenant's objection
to the owner's initial 1984 services registration.
The challenged order determined, among other items, that
certain recreational facilities were provided by the owner and were
required to be listed on the apartment registration of tenants who
were members.
On appeal, the owner contends that the part of the
Administrator's order dealing with recreational facilities should
be revoked because the recreational facilities are provided by a
separate independent entity, and thus not a service required to be
registered.
A search of Division records reveals orders by the
Commissioner concerning housing accommodations in the complex
remanding the issue of recreational facilities to the Administrator
to render a uniform determination. The proceedings, established on
remand under Docket No. EA 110062 RP, remain open and pending.
Accordingly, the Commissioner deems it appropriate to refer the
instant proceedings for consolidation therewith.

THEREFORE, in accordance with the provisions of the Rent
Stabilization Law and Code, it is
ORDERED, that the tenant's petition be granted to the extent
of remanding the proceedings for further consideration of the
question whether recreational facilities are a required service the
owner must register.
