            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW   
                                          

          The above-named petitioner-owner filed a Petition for Administra 
          tive Review against an order of  the  Rent  Administrator  issued
          March 4, 1987 concerning housing accommodations known  as  Apart-
          ment 4-L located at 141-153 East 56th Street, New York, New  York
          wherein the Administrator terminated the  tenant's  challenge  to
          the 1985 Fuel Report on the  ground  that  since  the  cumulative
          adjustment for 1980 to 1985 is $0.00, the issue of room count  is
          irrelevant.

          On appeal the owner states that the Administrator's finding  with
          regard to the 1980-1985 fuel cost adjustment  was  incorrect  and
          that this issue is being determined under Docket N .  AL  420238-
          RO.  The owner claims that it is filing this appeal to  "preserve
          its rights to any fuel cost adjustment for  the  applicable  year
          based upon a favorable determination" of the then pending  appeal
          under Docket No. AL 420238-RO.  

          The tenant filed a response to the petition on July 31, 1987.  In 
          that response she set forth four reasons upon which  the  Commis-
          sioner should deny the instant petition.  Those reasons were:

               1.   The  owner's  failure  to  timely  file  fuel  cost
                    adjustment reports in 1980, 1981, 1982, 1983 
                    and 1984.

               2.   The owner's alleged false certification,  that  the
                    1980 and 1981 fuel surcharges were  reinstated,  in
                    the eligibility section of the  request  for  years
                    1983, 1984, and 1985 when no proper  proof  of  the
                    reinstatement was offered.


               3.   The fact that the N.Y.C.  Department  of  Rent  and
                    Housing Maintenance specifically revoked  the  fuel
                    adjustments for 1980 and  1981  by  reason  of  the
                    owner failing  to  timely  and  properly  file  the
                    report, certification and notice of fuel  cost  ad-
                    adjustment eligibility and

               4.   The owner's alleged "harassment and  tenant  intim-
                    idation."

          On February 24, 1988 a decision was issued by the Commissioner in 
          Docket No. AL 420238-RO.  That decision denied  the  owner's  ap-
          peal.  The Commissioner noted that petitioner had failed to  file
          timely challenges to prior orders of  the  Administrator  wherein
          fuel cost adjustments for 1980 and 1981  were  suspended.   Since
          proper and  timely  appeals  were  not  taken,  the  Commissioner
          determined that the Administrator's suspension orders were final. 
          Petitioner did not seek judicial review of  this  ruling  of  the
          Commissioner.

          Since petitioner has based its position in this matter solely  on
          a successful ruling in Docket No. AL 420238-RO and since the 
          Commissioner denied that appeal this  appeal  must  similarly  be
          denied.  

          The Commissioner is of the opinion that  the  Rent  Administrator
          correctly decided the tenant's challenge to the fuel  report  for
          1985.


          THEREFORE, pursuant to the Rent and Eviction Regulations, it is

          ORDERED, that this petition be, and the same  hereby  is,  denied
          and that the Rent Administrator's order be, and the  same  hereby
          is, affirmed.
