            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

          On April 20,  1987  the  above-named  petitioner-tenant  filed  a
          Petition for Administrative Review against  an  order  issued  on
          April 3, 1987 by the Rent Administrator, 92-31 Union Hall Street, 
          Jamaica, New York, concerning the  housing  accommodations  known
          as 6574 Saunders Street, Rego  Park,  New  York,  Apartment  5-J.

          The Commissioner has reviewed all of the evidence in  the  record
          and  has  carefully  considered  that  portion  of   the   record
          concerning the issues raised in the administrative appeal.

          In the order appealed herein the Rent Administrator  granted  the
          owner's application for a rent increase based on the installation 
          of a major capital improvement (MCI) consisting of a new roof and 
          increased the rents for the rent controlled and  rent  stabilized
          apartments.

          In the petition the subject rent-controlled tenant  asserts  that
          the Rent Administrator's order should be reversed because  he  is
          a senior citizen wit limited income.

          The Commissioner is of the opinion that this petition  should  be
          denied. 

          The Rent and Eviction rEgulations do not exempt  senior  citizens
          tenants with limited incomes from MCI increases unless they  have
          been granted Senior Citizen Rent Increase exemptions.   There  is
          no indication  in  the  record  that  the  petitioner-tenant  has
          received such an exemption.  Accordingly, the owner  is  entitled
          to charge the tenant the appropriate MCI rent increase.


          THEREFORE, in accordance with the Rent and Eviction  Regulations,
          it is

          ORDERED that this petition be, and the same  hereby  is,  denied,
          and the Rent Administrator's order be, and  the  same  hereby  is
          affirmed.
