            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


          On April  3,  1987  the  above-named  petitioner-tenant  filed  a
          Petition for Administrative Review against  an  order  issued  on
          February 27, 1987 by the Administrator, (Gertz Plaza)  concerning
          housing accommodations known as 93-47 222nd Street,  Queens,  New
          York, Apartment 3R, wherein the Rent Administrator  restored  the
          rent of the subject apartment retroactively based on the  owner's
          restoration of services.

          The Commissioner has reviewed all of the evidence in  the  record
          and has carefully considered that portion of the record  relevant
          to the issues raised by the administrative appeal.

          In this petition the tenant  contends,  in  substance,  that  the
          conditions of items for which the rent was reduced have not  been
          corrected and that the Administrator improperly restored the rent 
          of the subject apartment.

          The Commissioner is of the opinion that this petition  should  be
          denied.

          A review of the record in the proceedings below established  that
          the conditions of items  (living  room  window  cracked,  bedroom
          window area walls has peeling paint  and  plaster,  exterminating
          services are not being  provided)  for  which  the  Administrator
          reduced  the  rent  were  restored  as  confirmed  by  the   DHCR
          inspectorial staff report.

          Accordingly, the Commissioner is of the opinion  and  finds  that
          the basis for the Administrator's order was warranted;  and  thus
          said order should be affirmed.

          This order is issued without prejudice to the tenant's filing  an
          application of a rent reduction for any decrease in  services  if
          the facts so warrant.

          THEREFORE,  in  accordance  with  the  provision  of   the   Rent
          Stabilization Law and Code, it is

          ORDERED, that this petition be, and the same hereby  is,  denied;
          and the  Administrator's  order  be,  and  the  same  hereby  is,
          affirmed on appeal.
