            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW   



          On March 27, 1987,  the  above-named  petitioner-owner  filed  an
          Administrative Appeal against an order  issued  on  February  27,
          1987, by  the  District  Rent  Administrator,  92-31  Union  Hall
          Street, Jamaica, New York, concerning the  housing  accommodation
          known as 51 Irving Place, Brooklyn, New York, Apt. 7-R.

          The Commissioner has reviewed all the evidence in the record  and
          has carefully considered that portion of the record  relevant  to
          the issues raised by the petition. 

          The tenant commenced the proceeding below by filing  a  complaint
          asserting that the owner had failed to maintain certain  services
          in the subject apartment.

          The owner did not interpose an answer to the tenant's complaint.

          Thereafter an inspection of the subject building was conducted by 
          a Division of Housing and Community Renewal (DHCR) inspector  who
          confirmed the existence of defective conditions.

          The Rent Administrator directed restoration of these services and 
          further ordered, a reduction of the stabilization rent.

          In his petition for administrative review, the owner  states,  in
          substance, that the tenant delayed access to the owner's  workmen
          for the purpose of restoring services.

          THEREFORE,  in  accordance  with  the  provisions  of  the   Rent
          Stabilization Law and Code, it is 

          ORDERED, that this petition be, and the same hereby  is,  denied,
          and the Rent Administrator's order be, and the  same  hereby  is,
          affirmed.
