ORDER AND OPINION TERMINATING PETITIONS ADMINISTRATIVE REVIEW
AND MODIFYING THE ADMINISTRATOR'S ORDER
On March 6, 1987, the above-named petitioner-owner filed a
Petition for Administrative Review against an order issued on
February 3, 1987, by the Rent Administrator concerning the
housing accommodations known as 224 Henry Street, Brooklyn,
New York, Apartment No. 3A.
On March 9, 1987, the above named petitioner-tenant filed a
Petition against the same order.
This proceeding was originally commenced by the tenant's filing
of a complaint on December 19, 1985 alleging the owner's failure
to offer a renewal lease.
In Order issued on February 3, 1987, the Administrator found that
the tenants were entitled to a two year renewal lease in both of
their names commencing September 16, 1986 and expiring August 15,
1988 at a rent of $299.61, as set forth in DRO Order No.
K 3102242-R, issued on October 1, 1986, which had determined the
lawful rent in that amount.
Subsequent to the filing of these petitions the Commissioner
issued an Order and Opinion under Administrative Review Docket
Number AL 21006-RO/AK 210042-RO, on June 1, 1992, wherein the
Commissioner revoked the underlying Administrative Order No.
K 3102242-R, having found that the actual rent of $313.13 on
July 31, 1984 was correct, and that there were no overcharges.
It is also noted that the tenants have been issued a lease in
both of their names, as directed in the order here under review.
Insofar as the owner has continued to offer a lease for both
signatory tenants, and does not contest this part of the subject
order in his petition, such issue is moot.
The subject order is hereby modified to conform to the
Commissioner's determination of the lawful rent in the PAR issued
on June 1, 1992 under Docket No. AL 210066-RO/AK 210042-RO.

THEREFORE, in accordance with the Rent Stabilization Law and
Code, it is
ORDERED, that the petitions of the tenant and the owner be, and
the same hereby are, terminated as moot, and the Administrator's
order is modified in accordance with the order and opinion issued
under Docket Number AL 210066-RO/AK 210042-RO.
