DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                      ORDER AND OPINION TERMINATING PROCEEDING

               On  February  26,  1987,  the  above-named  owner  filed   a
          Petition  for  Administrative  Review  concerning   the   housing
          accommodations known as 310  East  70th  Street,  Apartment  120,
          New York, New York, wherein the Administrator ordered a reduction 
          in rent based on a finding of diminution in services.

               The Commissioner  notes  that  the  instant  petition  is  a
          duplicate of a petition filed under  Docket  No.  BB  410222  RO,
          which has already been determined by an order and opinion  issued
          by the Commissioner on May 25, 1990.

               The Commissioner is accordingly  of  the  opinion  that  the
          instant proceeding should be terminated.

               Therefore, in accordance with  Rent  Stabilization  Law  and
          Code, it is

               ORDERED, that this proceeding be, and the  same  hereby  is,
          terminated.
